We (i.e. the specific company identified on this page as the operator of this website) believe that protecting the security and privacy of your personal data is important. This Privacy Notice explains how we collect, store, use, disclose and transfer (hereinafter "process") your personal data. The personal data that we collect about you depends on the context of your interactions with us, the products. Services and features you use, your location, and applicable law.
Categories of personal data processed and the purpose of the processing
When you visit our websites or use our applications or online services (each an "Online Offer"), we process information that you have actively and voluntarily provided about yourself, or that has been generated by us in connection with your use of the Online Services, and includes the following categories of personal data:

- To provide the services and features of the Online Services, which include creating and administering your online account, updating, securing and troubleshooting, providing support, and improving and developing our Online Offerings;

- To respond to and fulfill your requests or instructions;
- To process your order or to provide you with access to specific information or offers;
- To contact you with information and offers about our products and services, to send you additional marketing information, or to contact you in connection with customer satisfaction surveys as explained in Section 3; and
- To the extent reasonably necessary to enforce the terms and conditions of the Online Offering, to establish or maintain a legal claim or defense, to prevent fraud or other illegal activities, including attacks on our information technology systems.
Online offers provided by your organization
Our online offerings may be provided to you for use by the organization to which you belong, such as our corporate customers. If your Organisation provides you with access to an Online Offering, our processing of personal data provided by or collected from you or your organisation in connection with the content of the Online Offering is carried out under the direction of your Organisation and is subject to a data processing agreement between your Organisation and us. In such cases, your organization is responsible for all personal data contained in such content and you should direct any questions about how personal data contained in such content is contained to your organization.
Links to other websites
This Privacy Notice applies only to online offerings that link to this Privacy Notice and not to other websites or applications of our affiliates that have their own privacy notice or are operated by third parties. This Privacy Notice also does not apply in situations where we only process information on behalf of our business partners, such as when we act as a web hosting or cloud provider, and we may provide links to other websites and applications that we believe may be of interest to you. We are not responsible for the privacy practices of such other websites or applications.
Categories of personal data processed and the purpose of the processing
In the context of our business relationship with us, we may process the following categories of personal data about consumers and contact persons of (potential) customers, suppliers, sellers and partners (each a "business partner"):
- Contact information, such as full name, job title, work address, work phone number, work mobile phone number, work fax number, and work email address.
- Payment information, such as information necessary for processing payments and preventing fraud, including credit/debit card numbers, security code numbers, and other related billing information;
- Additional information that is necessary to be processed in a project or contractual relationship with us or that is voluntarily provided by the business partner, such as personal data about orders placed, payments made, requests and project milestones;
- Personal data collected from publicly available resources, privacy databases and credit reference agencies; and
- If required by law for business partner compliance checks: date of birth, ID number, ID card, and information about relevant and significant litigation or other legal proceedings against business partners.
We may process the personal data for the following purposes:
- Communicate with business partners about our products, services, and projects, such as by responding to inquiries or inquiries or providing you with information about products purchased;
- Planning, implementing and managing the (contractual) relationship with business partners; e.g., by carrying out transactions and orders for products or services, processing payments, performing accounting, auditing, billing, and collection activities, arranging shipments and deliveries, facilitating repairs, and providing support services;
- Administer and conduct market research, sweepstakes, contests, or other customer activities or events;
- Contact you with information and offers about our products and services, send you additional marketing messages, and conduct customer satisfaction surveys as described in Section 3;
- Maintain and protect the security of our products, services, and websites, prevent and detect security threats, fraud, or other criminal or harmful activities;
- Ensure compliance with legal obligations (e.g., record-keeping obligations), export control and customs, business partner compliance enforcement obligations (to prevent financial or money laundering offences), and our policies or industry standards; and
- To resolve disputes, enforce our agreements, and to establish, exercise, or defend legal claims.
Where and as permitted by applicable law, we may process your contact details for direct marketing purposes (e.g. invitations to trade fairs, newsletters with additional information and offers about our products and services) and to conduct customer satisfaction surveys, in each case also by email. You may object to the processing of your contact data for these purposes at any time by writing to contact(at)siemens-energy.com or by using the opt-out mechanism set out in the respective message you received.
We may transfer your personal data to:
- other affiliates or third parties – such as sales partners or suppliers – in connection with your use of the Online Offerings or our business relationship with you;
- third parties who provide IT services to us and who process such data only for such services (e.g. hosting or IT maintenance and support services); and
- third parties in connection with complying with legal obligations or establishing, exercising or defending rights or claims (e.g. for court and arbitration proceedings, to law enforcement and regulatory authorities, to lawyers and consultants).
Personal data published by you on online offers (e.g. chat rooms or forums) may be globally available to other registered users of the respective online offerings.
Unless otherwise stated at the time of collection of your personal data (e.g. in a form you fill in), we will delete your personal data if the storage of that personal data is no longer necessary (i) for the purposes for which it was collected or otherwise processed, or (ii) to comply with legal obligations (e.g. retention obligations under tax or commercial laws).
The data protection laws of the jurisdiction in which you reside may provide you with specific rights in relation to your personal data.
In particular, and subject to the legal requirements, you may be entitled to:
- Obtain confirmation from us as to whether or not personal data relating to you is being processed, and if so, access to the personal data;
- Request correction of inaccurate personal data about you;
- Request that we delete your personal data;
- Request that we restrict the processing of your personal data;
- Data portability of personal data, which you have actively provided; and;
- Object, on grounds relating to your particular situation, to further processing of personal data concerning you.
In order to protect your personal data against accidental or unlawful destruction, loss, use or alteration and against unauthorised disclosure or access, we use appropriate physical, technical and organisational security measures.

The Data Protection Organization will always take reasonable steps to address and resolve any inquiries or complaints brought to its attention. During our business relationship with you, we may share contact details of business partners with affiliated Siemens Energy companies . We and these Siemens Energy companies are jointly responsible for the proper protection of your personal data (Article 26 of the General Data Protection Regulation). In order for you to be able to exercise your rights as a data subject effectively within the framework of this joint data controller, we have entered into an agreement with these Siemens Energy companies that entitles you to centrally exercise your rights as a data subject under Section 6 of this Privacy Notice vis-à-vis Siemens Energy AG, Germany.

Legal basis for the processing
The General Data Protection Regulation requires us to provide you with information about the legal basis for the processing of your personal data.
The legal basis for our processing of data about you is that such processing is necessary for the purposes of:
- exercise our rights and perform our obligations under a contract we enter into with you (Article 6(1)(b) of the GDPR) ("performance of the contract");
- Compliance with our legal obligations (Article 6(1)(c) of the GDPR) ("Compliance with legal obligations"); Or
- · Legitimate interests pursued by us (Article 6(1)(f) of the GDPR) ("legitimate interest"). In general, the legitimate interest we pursue in connection with our use of your personal data is the effective performance or management of (i) your use of the Online Offerings and/or (ii) our business relationship with you. If the table below indicates that we are relying on our legitimate interests for a particular purpose, we will consider that its legitimate interests are not overridden by your interests and rights or freedoms, given (i) the periodic reviews and related documentation of the processing activities described herein, (ii) the protection of your personal data through our data protection processes, including our Binding Corporate Rules on the protection of personal data, (iii) the transparency we provide about the processing activity and (iv) the rights you have in relation to the processing activity. International Data Transfers
In the event that we transfer your personal data outside of the European Economic Area, we will ensure that your data is protected in a way that is compatible with the General Data Protection Regulation, and therefore, and where required by applicable law, we will take the following measures:
- We will share your personal data with affiliated companies outside the European Economic Area only if they have implemented our Binding Corporate Rules ("BCRs") for the protection of personal data. More information about BCR can be found here.
- We transfer personal data to external recipients outside the European Economic Area only if the recipient has (i) entered into EU Standard Contractual Clauses with us, (ii) implemented binding corporate rules in their organization. South Africa (Personal Data Protection Act, 2013 ("POPI")
For users located in South Africa, please note the following:
1. Under Section 1 of the Protection of Personal Information Act 2013, 'personal data' includes 'information relating to an identifiable living natural person and, where applicable, an identifiable existing legal person'.
2. The corresponding legal bases and conditions for lawful processing of personal data in South Africa can be found in sections 8 to 25 of the POPI and relate to "Accountability"; "Restriction of processing"; "Specification of the purpose". "Restriction of further processing"; "Quality of information". "Openness"; "Security Measures" and "Data Subject Participation".
3. Paragraph 69 of the Law on public procurement prohibits the processing of a data subject's personal data for the purposes of direct marketing by means of any form of electronic communication, including automatic dialers, fax machines, SMS or e-mail, unless the data subject has given his or her consent to the processing or is subject to additional conditions, an existing customer of the responsible party.
